STANDING UP FOR WORKERS SINCE 2006

Our nation’s employment discrimination laws reflect a collective commitment to the preservation of dignity and basic human rights in the workplace.  However, at times illegal and discriminatory workplace conduct can affect an individual’s workplace and unreasonably interfere with their ability to perform their job, or can create a work environment that is hostile, intimidating, physically threatening, or offensive.  When this occurs the lawyers at Winston Cooks, LLC are especially adept at helping employees recover compensation.

We regularly represent employees who have suffered discrimination based on their race, age, disability, taking of protected leave for medical reasons, or to care for a family member under the Family and Medical Leave Act, national origin, gender (including discrimination based on pregnancy and sexual harassment), family responsibilities, sexual orientation, and religion.

Please feel free to contact us for a free consultation with regard to any of the following areas of discrimination or harassment:

◦Race Discrimination Claims

◦Gender Discrimination Claims

◦Sexual Harassment Claims

◦Disability Discrimination Claims

◦Family Medical Leave Act Claims

◦Pregnancy Discrimination Claims

◦LGBTQ Discrimination Claims

◦Age Discrimination Claims

◦Religious Discrimination Claims

◦Wrongful Termination Claims

Sexual Harassment

You may have an actionable case if you have been subjected to unwelcome conduct by a supervisor or peer who creates a hostile environment based on your sex. The conduct must be severe and pervasive enough to alter the terms and conditions of your employment.

Discrimination

Federal law prohibits discrimination against employees, former employees and applicants for employment on the basis of their race, color, sex, national origin, or religion.

Disability Discrimination

The Americans with Disabilities Act (ADA) prohibits discrimination against "qualified individuals with disabilities," and requires public and private employers to make reasonable accommodations to job applicants and employees with disabilities.

Wage & Hour Disputes

These lawsuits include unpaid overtime and off-the-clock work, as well as misclassification of employees

Family & Medical Leave

This federal employment law provides employees who meet eligibility requirements up to 12 weeks of unpaid leave from their jobs annually due to their own serious health condition, a family member's health condition or for the birth of a newborn or adopted child.

Non-Compete & Sepration Agreements

Employers often exceed their legal rights when requiring employees to sign non-compete contracts or separation agreements

Whistleblower Claims

A number of federal and state laws protect individuals who report violations by their employer regarding federal tax laws, safety regulations or other illegal activity

Background Checks

Increased security measures by companies during the hiring process may include illegal investigation of job candidates' credit history or criminal records. A background check that does not concern your knowledge, skills, and abilities should not be used to deny you employment. If you have been denied a job because of a background check, please contact us to review the circumstances

Education Fraud

Students attending for-profit colleges may have been recruited by misleading information regarding tuition, teacher qualifications, graduation rates, job placement, and other false marketing. For-profit colleges saddle students with high debt and little prospects for employment at wages which justify the high expense. If you have given your social security number to a for-profit college and encountered misrepresentations in the cost, quality of education, or promises regarding employment, please contact us to review the circumstances.
